Ninth Circuit grants Trump administration's administrative stay hours after Judge Breyer's ruling on CA National Guard

 


Yesterday evening, an hour after U.S. District Judge Charles Breyer granted California Governor Gavin Newsom a temporary victory, the Department of Justice filed a motion with the Ninth Circuit of Appeals.

The Ninth Circuit Appeals granted the Trump's administration request for an administrative stay of Judge Breyer's temporary restraining order until a June 17 hearing which will be conducted by Zoom.

The three judges of the Ninth Circuit panel include Judge Mark J. Bennett and Judge Eric D. Miller both appointed by President Trump and Judge Jennifer Sung, appointed by Joe Biden.

Court documents posted below. The case is expected to go before the U.S. Supreme Court.
