Arrested for the death of her baby, pleaded guilty, Ewa Misztal has been at the State Hospital and 9 years later a jury trial is scheduled for another round of Schaffer vs Russo

 

Trial setting and petition for conditional release for Ewa Misztal was scheduled on 6/6. Readiness Conference is scheduled for 8/21 and a jury trial for 9/2. E court lists not guilty by reason of insanity.

On June 2, 2025 Judge Lawrence Killoran signed an order about a quarterly report from Harper Medical Group. PC 1605 is referred to in the report. PC 1605 states "the State Department of State Hospitals shall be responsible for the supervision of persons placed on outpatient status under this title."

Deputy District Attorney Carolyn Schaffer is the prosecutor for this case. Deputy Public Defender Casey Russo is Misztal's attorney.

Mr. Russo has been persistent in trying to get Mistal released for outpatient treatment. The DA has been in opposition.

Judge Kaleb Cockrum is disqualified on the case. Judge Steven Steward recused himself.

8/21/25: Readiness Conference continued by defense to 8/27.

8/27/25: Jury trial for "unconditional outpatient release remains set " for 9/2. Time estimate is 7 days. Mr. Russo said if no jury available, both defense and Ms.Schaffer have no objection to court trial.
