"The defendant is speaking English so we are picking that up"

Trial confirmation for Seng Yang, charged with  forcible rape and pornography charges involving his own daughter, was scheduled on January 15. Jury trial is scheduled for February 25 was confirmed for now.

Public Defender Marek Reavis told Visiting Judge Joseph Hurley that Deputy District Attorney Stacey Eads are having discussions about a resolution

The Hmong interpreter travels in from Sacramento. While waiting for his case to be called, Yang spoke with Reavis. He understands English. I made a note of that. It has been noted informally in previous hearings.

Today, Yang blew his cover by asking a note be given to the Judge. He didnt even consult his attorney. The Judge instructed him to talk to Mr. Reavis, first.

Then Judge Hurley said,   The defendant is speaking English so we are picking that up."

Mr. Reavis informed the Court, "Mr. Yang provided me an unsigned, undated letter. He wishes me to share with the Court and Ms. Eads. It is a possible negotiated offer."

Mr. Reavis said that since Judge Hurley is a Visiting Judge, here for this one hearing , he would not share it with the Court but he will with Ms. Eads.

Yang turned down a previous offer by the DA of 39 year prison sentence to resolve the case. Whenever, he is in court, he looks angry  defiant and unremorseful.

The alleged victim was in court with a support group, including her foster family. Yang's sister and other family members were in court as well.

Yang is charged with 16 counts which include forcible rape of Jane Doe (his own daughter) and exhibiting a minor in pornography.  Jane Doe is the alleged victim for all counts.

Text messages and pornographic videos are part of the evidence.

The case is being prosecuted by Deputy District Attorney Stacey Eads. Public Defender Marek Reavis is representing Yang.
