In an emergency court order, Stephanie Pearlston asks for Josh Pearlston to get limited visitation; requests Marci Kitchen not be allowed near her minor child and why

Stephanie Pearlston's request for child custody, visitation and temporary emergency court orders filed on August 4 request that, effective immediately, (if granted) that the respondent Josh Pearlston only be allowed visitation on Tuesdays and Thursdays from 2:30 to 4:30 p.m. and that "Marci Kitchen will not be present during visitation."

"That neither party shall make disparaging remarks about the other to or in presence of the minor child. Neither party shall discuss with or in the presence of the minor child court procedure or issues before the court."





Currently there is 50/50 visitation. Dissolution case is still pending.





In that three page declaration, Stephanie Pearlston says "I am saddened that I have to bring this request for emergency temporary orders to the Court's attention and request a temporary halt to our custodial schedule."

Then information about the Fortuna hit and run, the deceased minor girls, identifying Marci Kitchen as the mother of Kiya Kitchen is stated and Marci Kitchen as identified as "the live-in girlfriend of father herein, Josh Pearlston."

"What I have noticed over the last several weeks is that the father has been aloof regarding the above event. Although he is addressing he and Marci's legal needs he acts as if it will all "work out" and blow over.

She mentions one recent example as Josh and Marci wanting to take the minor child to Santa Cruz for a four day trip, during the first week of August, "only weeks after the death of Marci's child."

Stephanie Pearlston claims that Josh Pearlston is dismissive about her concerns of not wanting Marci Kitchen around his and her daughter.

She claims shortly after the death of Kiya Kitchen, Josh Pearlston admitted to her "he and Marci self-medicated taking narcotics (Valium and Xanax) to cope.

Stephanie Pearlston has filed an order in her domestic violence case to have a hearing on child custody and visitation

I first reported on Stephanie Pearlston's domestic violence prevention order against Josh Pearlston.

Since then Stephanie Pearlston has hired a private attorney, Mr. Michael Robinson and filed an order on August 4 regarding child custody and visitation. That hearing is scheduled for 8:30 a.m. on August 23.

Stephanie Pearlston also filed a Domestic Violence Prevention Order against Joshua Pearlston; this in 2015

There is a case management conference at 1:30 p.m. on August 22 in a family law case filed on August 26, 2015.

In this case, Stephanie Pearlston filed for a Domestic Violence Prevention order, with a minor child. She is the petitioner and the respondent is Josh Pearlston.


Josh Pearlston was sentenced in May 2011 for a case filed in March 2011.He was charged with using wireless phone while driving (not hands free). He was fined $159.

He was sentenced for another case later in 2009. Fined $ 270. Charge: exceeding maximum speed.

In July 21, 2009, he had another traffic/infraction case, which was "disposed before hearing" and records say it was a conviction. The last note was pay or appear on 11/20/09.

  2. So the parties of interest in a deadly hit and run case wanted to take the guys daughter on a trip to Santa Cruz!!!! Are you kidding me!! Wow that really tops it off not to mention his laid back view of this will all blow over. He has not a care in the world and it seems as though Marci Kitchen doesn't either. How could you even entertain the thought of taking your boyfriend's daughter on a vacation while your daughter's remains are not being released because you want to fight with ex husband over them. This has got to be the craziest case in the history of Humboldt. Even in her statement put out by her lawyer, given it was only in written form, you couldn't even feel any emotion behind her words, just defensive blaming towards husband. I'm at a loss for any more words. Please let this case be solved soon.
