Christopher McCarthy arrested by EPD for repeatedly calling 911 with intent to harass


Christopher Lenn McCarthy was arrested by Eureka Police Department yesterday for PC 653x calling 911 with an intent to harass.

EPD PIO Laura Montagna told me, "Repeatedly calling 911 stating he had an emergency. Warned not to do that, then calling again several times."

McCarthy was booked on a misdemeanor charge and released on OR. A person convicted of a misdemeanor can face up to six months in jail and/or $1,000 in fines as well as any unnecessary emergency response costs.

I had already added information about Michael Black's fourth arrest on August 2 to my July 15 post about his third arrest. Today  HCSO issued a press release with details about Black's most recent arrest. He posted bond yesterday.

 Thavisak "Lucky" Syphanthong made this initial announcement on Facebook and I just confirmed with City of Eureka Assistant Manager and Clerk Pam Powell. Eureka Councilmember Scott Bauer is the incumbent for Ward 4. Waiting to hear back from Syphanthong.

DA rejects APD report, no charges filed for Joshua Neff arrest

 





Many of you read the Epic Fail post yesterday which is relevant to this brief Joshua Neff update. If you haven't, please do for context and more details on APD and the DA's decision. Some of you can benefit from the brief mini lesson "Joanna" got for free on the local criminal justice system and how arrests, investigations, charging decisions and reporting works.

Today, the sun and the moon and the stars briefly aligned. Just kidding. If "Joanna" had just waited one more day, both of us could have saved some time. After a very busy week,I got up at the crack of dawn, went to the courthouse checked on several cases. I had planned on checking on a few arrests and Neff's was one of them. Despite trolls, despite another non stop week of being busy, thanks to the hardworking court and DA staff, I confirmed the DA rejected the APD report and no charges were filed f  Neff's July arrest.

Bye bye vending machines, cafe on the third floor to open again?

The cafe on the third floor courthouse has been closed for years. Since I have been going to the courthouse regularly it used to be Mj's Cafe. When Jeanie sold it, it became Smokestack Cafe.

Gabrielle Long is the owner of Taste of Bim, The Grind, the cafe at the airport and Tasty Hub.

I had mentioned to Gabby she should buy it and why. With judges, attorneys, bailiffs, jurors, court and county staff, that is a steady business. Reasonable prices, fast and good customer service is the key to success.

She looked into it before but ended up opening The Grind. I heard last week that Gabby has an agreement negotiations and she is opening the cafe. The Grind will close soon; by the end of August.

I have contacted Gabby. She responded. I have done several posts on the cafe in the courthouse and if you are not a regular reader, you can catch up on prior posts via links provided.

Security National's Kenny Carswell will be a Eureka Ward 2 challenger if signatures are verified

Kati Moulton has at least one challenger for her Ward 2 seat. I have previously reported she was running for re-election. She made an announcement but she has not turned in any forms, yet.

I have been checking in regular with City of Eureka Assistant Manager and Clerk Pam Powell. She just confirmed that "the only signatures that I just received this morning are from Kenny Carswell in Ward 2. They are waiting to be verified."

Three people have picked up packets for Eureka Ward 4. Will Mike Munson be one of those challengers? See July 25 post.

I wanted to confirm with the City of Eureka which I did this morning. I have no idea if Carswell has or will send out a press release and if I will be included. I have reached out to him via email.

Carswell responded promptly, explained the delay and apologized. I have added the campaign press release to the post which has a quote from Will Adams, president of ACGC, Inc. (Adams Commercial General Contracting) endorsing Carswell's candidacy.

What should have been a simple hearing turned into.a two day ordeal because of one petty attorney and his ego

 


Tomorrow, preliminary hearing is scheduled for alleged rapist Burt Coffelt. There was a fourth continuance requested by the DA because  the investigator was not available but also because defense had not provided medical records to the People. Once again, Deputy Public Defender Nims cannot follow basic legal procedure. Preliminary hearing rescheduled to 8/12.

There have already been three continuances by the defense. Since it is a Public Defender case and also  assigned to Nims, this a last minute continuance is no surprise. It could have been no courtroom unavailability. Atleast Nims has not thrown a hissy fit if the case gets assigned before Judge Killoran and waste more time and resources because his teeney weeny ego can't handle being correctly called out for not following the law.

I was checking the Coffelt case to see if a motion to continue was filed on Friday and saw defense filed a motion to reconsider custody. This was done after my last post. So, I checked the minutes. What should have been a simple hearing turned into a two day ordeal because petty Nims' has been pouting ever since Judge Lawrence Killoran ruled against him for violation of motions in limine during a trial on other case.

Nims disqualified Judge Killoran on 7/18 so the hearing was continued to 7/19 when Judge Kaleb Cockrum denied the defense motion on bail & custody status. Details in court minutes. Will Nims be disqualifying Judge Cockrum too?

Jane Doe 2 continued her testimony on 8/2 in alleged molestor Gary Landergen's jury trial and stood her ground with Conflict Counsel Supervising Attorney Meagan O'Connell. Defense efforts to impeach Jane Doe #2 backfired. She came across as credible, strong and ended up helping the People's case. 

DA files declaration in 7th & I collision suspect case

 



On 8/2, I checked the Maria Cuevas case and the DA had filed a declaration and order shortening time that day. The documents were not in e court and no other information in e court. If they are later, I will add them. I can tell you that the DA's motion addresses Gregory Kreis being appointed as Cuevas' attorney. Cuevas is the suspect in the multi vehicle collision on 7th and I.

On August 1, I did a post on Gregory Kreis and a potential conflict in another case. In that post, I wrote what I have said since July. "I was the first one to report on July 9 that Kreis would be appointed as Maria Cuevas' lawyer and why that is a conflict. On July 27,  I reported the entire Humboldt bench recused themselves after Kreis was appointed. If Cuevas is convicted, Humboldt Superior Court has already set up grounds for appeal by letting Kreis be her attorney."

John Provolt tried to surrender but the warrant was not in the system yet

On 8/2, I checked to see if the arraignment date for John Provolt's sex abuse had been fixed. I confirmed with the DA's office the same information that was in e court and that the matter was off calendar. 

In e court, there was an arrest warrant issued on 8/1 which did not show up on the systems until 8/2. I confirmed that Provolt tried to surrender at the jail on 8/1 Thursday but because the warrant was not in the systems, he could not so now he will have to go back. Provolt was booked into jail on the arrest warrant on 8/3. He posted bond. On 8/15, arraignment date of 9/16 was finally entered in e court. On 9/16, Provolt was arraigned. He is represented by Christian R. Jensen. Setting of preliminary hearing on 10/29.

Just a glimpse of 24 hours and the abuse I face for doing a blog in Humboldt which is the "Devil's playground"

I wrote about convicted sex offender Benjamin Pesch's case which concluded months ago. I do keep tips and emails confidential even those I receive misusing my email address. Most people will back off after one response. I can always sense the ones with a red flag and once again, I was correct about this one email that set off my radar.

Since August 1 throughout this morning , this one particular abusive, persistent troll misused my email address, harassed me repeatedly, tried to use my genuine concern for survivors and the time I put in covering news on cases others ignore to constantly attack and interrupt my ability to work amidst other challenges I face on a daily basis just to survive.

This is someone I believe is a danger to me and this community. Despite repeated warnings, this troll still won't stop. I am only giving you a snippet of the email exchange.

There were 46 cases on the trial assignment calendar today. I did see DA Stacey Eads in the courtroom and on the second floor today. Several jury trials, including a few I am covering were continued and rescheduled.

In the Redwood Meat saga, the real story other local media left out is that Humboldt Auction deal to buy it fell through and Ray Christie is interested in the business

The moment I saw the Redwood Meats story in Lost Coast Outpost which as usual then appeared in other media which hardly covers lawsuits or original content unless they are given a "tip" by stakeholders who know the the coverage will be skewed and spun to what they want out there and relevant news ignored. 

HCSO arrests 16 year old felon for attempted homicide of 17 year old victim

On June 27, 2024 at about 3:27 p.m., Humboldt County Sheriff’s deputies were dispatched to the 900 block of Tish Tang Rd., Hoopa for the report of a possible homicide attempt involving a firearm.
