Trial setting for murder suspect Ulisses Rodriguez was continued to April 15. A motion to compel discovery by defense is scheduled to be heard on that date. Prior to that, today a motion to file under seal by Ms. Andrea Sullivan, Rodriguez's attorney was heard and granted today by Judge Lawrence Killoran.
Deputy District Attorney Luke Bernthal said that in order not to compromise other Humboldt County Drug Task information and investigations, the People are willing to provide the entire cell phone "dump" of confidential witness John Doe to defense under a protective order.
"That doesn't solve the privacy issue for John Doe," said Mr. Bernthal.
Ms. Kathleen Bryson, John Doe's attorney has expressed objection but not yet filed any motion.
Ms. Sullivan is willing to look at the terms of the protective order. She said "Under Brady, my client is entitled to this third party discovery."
"John Doe is the only precipient witness to identify my client," said Ms. Sullivan. The information requested is for potential impeachment/credibility of John Doe.
Judge Killoran granted Ms. Sullivan's request that the motion to compel; declaration in support of motion and supporting declaration will be filed under seal to protect the identity of the prosecution’s witness John Doe.
