"The decision you need to make in this case is are they true disclosures or fabrications?
Using testimony, evidence, the legal concepts of reasonable doubt, presumption of innocence and proof beyond a reasonable doubt, Deputy Conflict Counsel David Lee gave the best closing argument I have covered in the Humboldt Superior Court.
It is not possible to create the effect of listening to him in the courtroom today, the passion, the emotion or the effectiveness. You just had to be there.
Mr. Lee acknowledged this case has horrific charges and it is a hard verdict to render. He did not question Count 9, the only non sexual charge in the case but asked the jury to consider the lesser charge of battery. They will have a verdict form with that option.
As for the rest, he asked for a verdict of not guilty.
The defense does not have the burden of proof; the prosecution does. If you have been following this case regularly on my blog, many of the points covered in Mr. Lee's closing argument will bring back testimony and evidence presented at this trial.
Using timelines, disclosures, inconsistencies in testimony and motive, Mr. Lee went through all the John Does, James Doe and Angela Fisher.
