Chad Smith's stepdaughter sent him a bikini pic, told him "I'm so horny" and about "pleasing herself in the bathtub"

Jane Doe #1's took the stand today and cross examination resumed. She was on the stand most of the day. There was redirect and recross. Both Ms. Andrea Sullivan and Deputy District Attorney Stacey Eads read excerpts from emails.  These emails were all after the restraining order. Ms. Sullivan showed an email from Chad Smith to Jane Doe #1 to the jury.

Which Jane Doe will the jury believe? Jane Doe #1 switched from bring rude, giving attitude and being defensive with Ms. Sullivan to wiping her eyes and suddenly tearing up when talking with Ms. Eads. She had no memory issues when Ms. Eads questioned her.

Similar to yesterday, Jane Doe #1 was defensive when emails and words written by her backfired on her. Today, she looked over at Smith and instead of  just short glances, stared at him to see if he was reacting. Smith would be writing notes or talking to his attorney.

When asked by  Ms. Sullivan about the inconsistency between what she said during the preliminary and yesterday in court about swallowing ejaculate, Jane Doe #1 said she did not contradict herself.

Jane Doe #1 said Chad Smith didn't force her to swallow his semen. "It was expected of me. Because he told me good girls don't spit."

Jane Doe #1 admitted that she did not tell anyone about the good girls dont spit remark, including investigators this and the first time she shared this was in court today.

She said  Smith allowed her to smoke pot but he also grounded her for smoking marijuana.

Jane Doe said Smith did not send her dirty pictures. She said she could not remember sending Smith dirty pics.

"I said inappropriate stuff to him but he would stop me from saying those things."

In one email, Jane Doe #1 asked Smith, "Just out of curiosity, do you still have feelings for Amy?" Amy Smith is her mother and his former wife.

Chad Smith responded, "Why does that bother you? If so,don't let it."

Another email which was shown to the jury on a monitor was about Chad Smith telling her that her communications were inappropriate.

"The love you have for me is not a father-daughter relationship. You have a crush on me." He told her this was not healthy. Smith denied any sexual acts between them.

"My intention is only to be your father and nothing else. I have contacted the DA to let them know I violated the court order. I made poor choices to guide you."

Smith told Jane Doe #1 he had no idea what she meant about Jane Doe #2. "I have never been inappropriate with a child. I have never been sexual with a child. That's gross."

Smith told Jane Doe #1 he was ceasing all communication.

Ms. Sullivan asked Jane Doe #1 about another emotional email she sent to Chad Smith. Jane Doe #1's response was, "Because the man I loved was breaking my heart." Jane Doe #1 did not cease communication with Chad Smith until her mother found her journal.

During redirect by Deputy District Attorney Stacey Eads, she went through almost 20 emails, most of them were about father-daughter type communications like a winter formal dress and Jane Doe #1's low self esteem.
Nothing in those emails is sexual.

Smith does come across as manipulating Jane Doe #1 regarding Amy Smith.

The allegations are all based on what Jane Doe #1's claims. If the jury believes her despite her inconsistencies and defensiveness, then as Ms. Sullivan said, "this case hinges on Jane Doe #1's credibility." 11 of the 16 counts pertain to Jane Doe #1. Smith has already admitted to violating the restraining order. Those 4 counts will be easy for the prosecution to prove. Only one count is related to Jane Doe #2.

Only one email about the bikini pic that Jane Doe #1 sent to  Smith asking about what he was thinking and the futon and Smith's cryptic response was one that can be interpreted as incriminating.

During recross, Ms. Sullivan read an email from Jane Doe #1 that expressed anger at Smith. Jane Doe #1 is the one that sent emsils saying she was horny and pleasing herself in the bath tub. Smith asked Jane Doe #1 if a guy her age was interested in her and when she put herself down, he bolstered her self esteem.

During recross, it was also brought out that Chad Smith wanted to work things out with Amy Smith.
