A very different Jane Doe #1 testified in court today compared to the one at the preliminary hearing. She did not look at Chad Smith initially; however as testimony proceeded, she would glance over at him; especially while testifying about the sexual acts. These were not angry or glaring looks she was giving Chad Smith.
A support person accompanying her during testimony is an older guy. Usually for such cases, Jane Does have been accompanied by a support person who is a woman.
There was a lot of anger from her at the preliminary hearing but today, so far, she is very matter of fact. I covered the preliminary hearing in detail so my coverage will include new information presented during the jury trial.
There was more testimony about sodomy today. Jane Doe #1 said the first time Chad Smith had anal sex with her, she was intoxicated. He gave her bud light. She didn't tell him to stop. She testified it was painful and that another time, she told him to stop, she was crying. She said Chad Smith pulled her closer and had sex with her until he had an orgasm.
Compared to the detailed testimony at the preliminary hearing, some answers by Jane Doe #1 were less graphic. There was a lot of "I can't recall" and"I don't remember." Some of her testimony was consistent with the preliminary hearing.
After the lunch break, her memory was better about some incidents. There were inconsistencies. At the preliminary hearing, she said that she swallowed after giving Chad Smith a blow job because she thought that is what she was supposed to do; today she said Chad Smith told her to swallow.
At the preliminary hearing, she said that the first time Chad Smith had vaginal sex with her, it felt good. Today, she added that it was also painful.
During cross examination, Jane Doe got defensive when confronted with statements she made to the older guy in England such as telling him, "most guys like a high ponytail" and "corrupts young boys and fucks men."
Jane Doe #1 also told the guy in England, "I'm such a slut."
Jane Doe #1 said she wanted the older guy in England to think she had a lot of sex partners and creating this fantasy life "so he would like her more."
Jane Doe #1 repeatedly referred to both Smith and the guy in England as her boyfriend. She repeatedly said she was in love with Chad Smith. She told the guy in England and Chad Smith about each other. Jane Doe #1 told the older guy in England "that my stepdad was having sex with me. He didn't seem surprised."
Master and Kitten were characters in the show Thundercats that Jane Doe #1 watched with Chad Smith. During direct testimony, Jane Doe #1 said these nicknames were used during sex. During cross examination, she didn't rember why Chad Smith said he called her kitten.
A defense exhibit which was conversations between Jane Doe #1 and Chad Smith showed amore of a father daughter chat. After fighting with her mom, Jane Doe #1 messaged Chad Smith saying, "Daddy, I need your help."
Using her own emails, Ms. Sullivan asked several questions and Jane Doe #1's defensiveness and some attitude came through. At one point, Judge Christopher Wilson told her to just answer the question.
Jane Doe #1 was fine while testifying during direct but when confronted with her own words during cross examination and after saying certain things she said were not true when transcripts were read, at one point, she suddenly grabbed a tissue and started crying. Testimony resumed after a 10 minute break.
In her "journal", Jane Doe #1 said that "electric shocks" went through her body when Chad Smith was rubbing her vagina and that she rotated his hand. She told Ms. Sullivan that it was the part that was inaccurate was that she moved Smith's hand.
The same day Amy Smith discovered Jane Doe #1's letter/journal about Chad Smith touching her; Amy Smith also found out about the older guy in England . This happened when the guy messaged Jane Doe #1 on her phone.
Jane Doe #1 lied to her mother that the older man online told her what she wrote in her journal.
Amy Smith wanted to send Jane Doe #1 to Alaska to get her away from Chad Smith. Jane Doe #1 said she thought it was because Amy Smith was jealous of her.
Jane Doe #1 is still on the stand.
