Chris Craft will not be tried as an adult thanks to SB 1391

Due to Governor Brown signing SB 1391, the District Attorney had to withdraw their motion to transfer Chris Craft's juvenile case to adult court. Craft is charged with the murder of Brandon Brocius.

Deputy District Attorney Jessica Watson told Judge Joyce Hinrichs that she is withdrawing her motion for transfer due to SB 1391. The motion was granted by Judge Hinrichs, "without prejudice."

Setting for a 602 contested hearing is set for November 15. That hearing when scheduled will be a two week, full day hearing. Craft's presence was waived for that hearing.

Excerpt from SB 1391:

"This bill would repeal the authority of a district attorney to make a motion to transfer a minor from juvenile court to a court of criminal jurisdiction in a case in which a minor is alleged to have committed a specified serious offense when he or she was 14 or 15 years of age, unless the individual was not apprehended prior to the end of juvenile court jurisdiction, thereby amending Proposition 57. By increasing the number of minors retained under the jurisdiction of the juvenile court, this bill would impose a state-mandated local program."

Craft's attorney Ms. Christina Allbright has filed a motion for reconsideration. That will be heard after she files supplemental pleadings.

Dressed in a green shirt with a Humboldt logo and light khaki pants, Craft briefly spoke with Ms. Allbright, who sat next to him in the Courtroom in the jury box.

Deputy DA Roger Rees who is the prosecutor for co-defendant Lorna Leen's case was in court with Brocius' family for support. Leen is Craft's mother.

Only North Coast News and I were in court for this hearing today.
