"Each witness has slightly different vantage but we think we can piece together enough for probable cause"


"We would ask that the Court hold Mr. Zoellner to answer on charges," said Deputy District Attorney Roger Rees.

Mr. Rees acknowledged "There's a lot of conflicting" versions of events that occurred that night. "A series of confusing events."

"Each witness has slightly different vantage but we think we can piece together enough for probable cause" that "Mr. Zoellner committed this crime."


"Some had consumed different substances. There were different levels of intoxication."

"What everybody testifies to there is an altercation. Someone punches Mr. Zoellner.
Ms. Bobadilla and Ms. Ortega end up in an altercation. Somehow that altercation ends."

"There's some concern that there maybe some bias or agenda being friends of the victim but Mr. Wright was alone" with Josiah and Zoellner but he doesn't say he saw a knife or stabbing, said Mr. Rees, adding that lent credibility to Wright's testimony.

"I can't explain Jason Martinez." Mr. Rees said Martinez waited two days before saying anything "two quick jabs". He was with "Ace" who says nothing about it.

"There's a lot of stuff that happened in the beginning that's confusing, there's a lot of stuff in the end that's confusing. The only reasonable conclusion is that the two boyfriends of the two girls started fighting."

Mr. Rees referres to Wright seeing Josiah fine, with no injuries at the ebd if the driveway, then heading back towards Zoellner, where Bobadilla and Ortega and Wilkins are allegedly in a confrontation. Wright heading back to check on his friend, and testifying seeing Josiah and Zoellner together.

"Somewhere between those 20-25 seconds, the defendant stabbed Josiah."

Mr. Rees referred to parts of testimony by witnesses that supported the prosecution theory throughout his oral argument.
