Did Deputy DA Steward lie to or mislead Judge Wilson?

 


On November 30, there is a hearing scheduled on motions in Ray Christie's Humboldt Superior Court criminal case. I am very curious to see what move the District Attorney's office will make next.

Christie's cell phone which was seized during the federal raid was returned to him after the federal prosecutor read the defense motion to suppress. That motion was a separate filing in federal court.

Remember, after the federal raid, HCSO PIO Samantha Karges answered my questions. The only one not to answer my questions since then has been Humboldt County District Attorney Maggie Fleming and Deputy District Attorney Steven Steward.

Since the Larson Law Firm was retained by Christie, the defense has requested several transcripts of court proceedings. It is unfortunate that needs to be done and not every one has the means to request transcripts and fight the system as it is costly. This is how a lawyer should represent  you. 

Court reporter transcripts are not disputed. They are accepted as accurate and facts and the final word. If you have been on a jury, this is read to you in jury instructions.

Throughout this case and many other cases I have covered in Humboldt Superior court I document details because from experience I know court minutes can be inaccurate and what is stated in court at hearings is not what happened or was stated previously. People's lives and freedom are at stake.

Judge Christopher Wilson is the trial judge for Christie's retrial. He also presided over Christie's first retrial. As I previously reported, he was going to be gone from  November 22 and returning after the New Year in 2022.

At the November 15, hearing, Judge Wilson informed the attorneys he would be gone. There was already one defense motion noticed for November 30. Judge Wilson indicated that it would be reset and calendared before him. If  Mr. Steward is unavailable on November 30, why is this hearing calendared? This is how Humboldt Superior Court wastes time and resources. Why didn't Judge Wilson just reschedule the hearing for a day when he returns?

Larson Law Firm's Mr. Rick Richmond is one of Christie's attorneys and the primary attorney who has appeared in court hearings; in person. Other associates have appeared in court and via Zoom but not addressed the court.

Mr. Steward is the prosecutor for this case. He took over the case from former Deputy District Attorney Adrian Kamada who abruptly left the Humboldt DA's office. Mr. Kamada's exit was after the first jury trial for Christie. The first jury was hopelessly deadlocked on the felony counts and some of the misdemeanor counts.

The defense filed more documents on November 24. So what will happen on November 30? Mr. Steward has not filed a response to defense "suppression motion". By law if there is no opposition, the defense motion should be granted.

On November 30, will the DA's office be allowed to make excuses? It is the DA's office and Humboldt Superior Court that has been pushing to get the Christie trial scheduled despite defense not having information required to adequately represent Christie. This while 2016, 2018, 2019 homicide and other serious cases are being scheduled for summer of 2022.

If you have not been following the detailed, regular coverage including the exclusive information on the federal raid at Christie's home; you need to read the previous posts and start keeping up with the developments. I am not going to spoon feed context in every post when links to previous coverage are provided.

This is a small town. There are numerous conflicts of interests but they are conveniently ignored wheb it suits the locals part of the status quo. My previous posts only scratch the surface. The local private property groups have been silent regarding Christie's case. The SJWs and others locally who are typically using immigrants for their agenda have no issue with ranch hands being harassed in the Christie case. Humboldt is hypocritical; Humboldt selectively enforces and Humboldt politically targets those who speak up against injustice, corruption and simply want to be treated fairly and have the truth heard.
