OR/bail hearing was scheduled for assault suspect Richard French on May 6. He is charged with felony assault with a deadly weapon. Bail was set at $35,000.
French had another 2020 case on calendar. The charge is a misdemeanor and an alleged violation of PC 166 (a) ) (4), violation of a court order.
Deputy District Attorney Jane Mackie told the court that French violated his restraining order in this case involving another neighbor. She commented that serving him with another CPO won't do much good but she had one prepared for the most recent case.
She gave Judge Timothy Canning a letter from the alleged victim. She said " the victim is really afraid for his life."
Deputy Public Defender Ben McLaughlin said the contents of the letter are one point of view and are subject to cross examination. "Mr. French felt his conduct was self defense."
Mr. McLaughlin said French had a 0 score risk assessment. "I have never seen that before; for any criminal defendant."
Probation reccomended supervised release be denied. Judge Canning agreed with Probation.
"As far as supervised release, this is a close case," said Judge Canning. While French had a low score on the risk assessment, "the problem is that the system is not designed to deal with serious,violent felonies."
Preliminary hearing is scheduled for May 12.
