Brady information, an arrest of John Doe and his attorney taking FFCRA leave will impact Ulisses Rodriguez trial


At trial confirmation for murder suspect Ulisses Rodriguez this morning, defense reitetated that the jury trial scheduled for June 29 is unlikely to proceed. Further trial confirmation and hearing on motion to continue is scheduled for June 2 at 8:30.

Victims are Tiffany Marie Ellebrecht and Jeremy Dieter Kuemmel.

Deputy Public Defender Ben McLaughlin is Rodriguez's attorney. Deputy District Attorney Roger Rees is the prosecutor on this case.


At the last court hearing, Mr. McLaughlin said  "the likelihood that this goes out" on date currently set is slim, given the current situation with COVID 19. Defense is still doing ongoing investigation. A motion regarding disclosure of a confidential informant may be filed by defense.

Rodriguez wants his jury trial asap however a time waiver has been entered over his objection. Mr. McLaughlin spoke with Rodriguez today and there was no objection from Rodriguez today.

Defense made an oral motion to continue for "a myriad of reasons.". Request was made to the People for name of confidential informant which led to the arrest of a John Doe on Health and Safety Code charges. Defense believes Brady information was told to law enforcement.  Other reasons for the continuance are the impact of the coronavirus pandemic on the courts; Rodriguez's case not having priority; the defense doing investigation pertaining to DNA and witnesses and Mr. McLaughlin taking Families First Coronavirus Response Act Leave (FFCRA). Mr. McLaughlin will not be back until the school year starts.

Mr. Rees already has the Brandon Watson trial scheduled for August and the  Gearold Sotolongo trial in September. He did not receive notice for the motion to continue but waived written notice since he has time before the next court hearing to inform the families of the victims.
