In person preliminary hearings are time consuming and restricted due to coronavirus impact on the courts
Richard Haberman's preliminary hearing was scheduled for May 21. It was continued at the request of defense and on the Court's own motion to August 5.
Haberman is out of custody and he has waived time. One of the reasons is that he wants to be personally present for his preliminary hearing. Deputy Public Defender Wade Orbelia said Haberman is a caregiver for his wife who is undergoing chemotherapy and this puts him in a "high risk" group affected by COVID 19. There is "ongoing discovery" which includes search warrants and affadavits.
Deputy District Attorney Tobias Hasler was present for the People.
"In person hearings are very time consuming and we are restricted due to limitations" of coronavirus and courtroom availability, said Judge Kaleb Cockrum. There are also several not time waived preliminary hearings scheduled for today.
Haberman was arrested in connection with the same investigation that led to the arrest of local attorney, Michael Acosta.
