"Allowing inmates who have been sentenced to CDC to linger on in jail contributes to overcrowding and violence."


The sentencing that never happens.

"Is that still what you want to do?" Mr. Russ Clanton asked James Pawlyk before his case was formally called today. New attorney and Pawlyk went into the same mode. This time fortunately, only a few minutes.



"We are not ready to proceed," Mr. Clanton told Judge Kaleb Cockrum. "I have never met Mr. Pawlyk before this morning. Mr. Pawlyk wants further discussion before he feels comfortable to have new counsel represent him  at sentencing."

"The People object," said Deputy District Attorney Luke Bernthal.  He said that Pawlyk pleaded guilty to a stipulated sentence in August. "All we need is a credit report."

"Allowing inmates who have been sentenced to CDC to linger on in jail contributes to overcrowding and violence," said Mr. Bernthal.

Mr. Clanton said Pawlyk had no disciplinary issues in jail and reiterated that "circumstances change" and did since the last continuance.

James Pawlyk sentencing scheduled for today was continued for a third time. This time a brief and final continuance to January 3.

Judge Cockrum said, " I feel the same way as Mr. Bernthal does," but he wanted to be fair to Pawlyk. " The PD had a late conflict. Mr. Celli has left. He has had issues with two attorneys who have left on the day of sentencing."
