In his latest filing on behalf of former court reporter, Patrik Griego claims County is negligent and either lost or destroyed her employment records

I just did a post on December 11, 2024 on former Humboldt Superior Court reporter Kay Gibbs' lawsuit against the County of Humboldt. 

Del Norte Superior Judge Darren McElfresh has ruled twice in favor of the County of Humboldt. The law firm of Liebert Cassidy Whitmore has been retained by the County. Janssen Malloy's Mr. Patrik Griego represents Gibbs. Mr. Griego told me that he is doing this pro bono.

Mr. Griego filed a post demurrer on December 18, 2025. As I was getting ready to include the court document in the post, I noticed the date of October 25, 2024 on the first page. I reached out to Mr. Griego. He responded, "You have to put the date of hearing on caption.  The hearing was October 25, 2024.  The brief is a post hearing brief on the October 25th hearing. "

What is typed below on the first page is what you should read.

If you are someone who has not followed my coverage of the case or does not want to read the entire court document, the summary of Mr. Griego's argument is on that first page. Mr. Griego says the individuals listed on the complaint were negligent; lost or destroyed Gibb's employment records. This involves CalPERS. 

Humboldt County Human Resources Director Zachary O'Hanen, former Humboldt County HR Interim Director Linda Le and Human Resources Technician Kara Fales are listed as individual defendants. In addition to defendant County of Humboldt, there are Does 1 to 50.

Patrick Cloney has been lamenting about CalPERS for decades online. Whether the topic calls for it or not; he will work it into a comment.
