This morning 7th and I collision suspect Maria Cuevas has a preliminary hearing scheduled which is a special set assigned to Retired Judge Ksenia Tsenin. Due to her DUI charges, Cuevas is ineligible for diversion in California.
Previous time esitimate was four hours. Deputy District Attorney Ian Harris is the prosecutor. Ms. Andrea Sullivan is Cuevas' attorney. She appeared via Zoom as she had just resolved up a case supposed to start trial in Ukiah.
One of the alleged victims is Humboldt Bar Association President and former Public Defender Jennifer Dixon. Ms. Heidi Holmquist Wells represents one of the alleged victims. Ms. Wells was not in court today but Ms. Dixon was present. Supporting her were two other colleagues including Mr. Douglas Kaber. Mr. William Stein represents the family of the other victim, David Sprague. He was in court with family members. After court, I saw him speaking with local investigator Mr. Adam Laird.
One of the delays was that Cuevas requested a Marsden hearing. That was brief and the Marsden was denied. The hearing is expected to last all day. Another reason was that Cuevas would not waive her right to a continuous preliminary hearing and there were scheduling issues with some witnesses.
Deputy District Attorney Roger Rees was filling in today for Mr. Harris who is the prosecutor for the case. In addition to civilian witnesses, three officers are expected to testify. EPD Officer Phillips, Nunez and Bailey. Due to scheduling, Mr. Rees made an oral motion to continue.
