"This Court has put me in jail for smoking weed."

21 year old convicted felon Logan Brewer-Hearst has learned nothing. He was given a chance after chance, including today, to own up and be a man.

Instead, he whined. "This Court has put me in jail for smoking weed." Then he went on to respond to the allegations in the probation petition by saying  "If they are going to put me into jail for every little thing, I just didn't show up."

Logan Brewer-Hearst could have resolved his case today. This was a hearing in his juvenile case for probation violation. Brewer-Hearst did not deny the allegations. The warrant was issued in October.

Humboldt Superior Court Judge Kelly Neel read the allegations from the petition. On July 23, Brewer-Hearst tested positive for drugs. On August 23, use of alcohol. On August 27, positive drug test. On September 23, 24 and 25 failure to report.

Probation had made an offer to resolve the case for 90 days jail time. Judge Neel said that she was not amenable to that resolution. It was moot because that offer by Probation was only as long as no new crimes were committed. Judge Neel also said she would not release Brewer-Hearst for residential drug treatment because that had been tried and it did not work. Deputy DA Alison Herson said the offensès Brewer-Hearst was charged with were serious.

Brewer-Hearst will be arraigned, most likely tomorrow on his EPD arrest as an adult. Ms. Jennifer Dixon cannot represent him in the adult criminal case due to health reasons.

Ms. Dixon is one of the alleged victims in the Maria Cuevas 7th and I collision case. While for legal reasons, I use the word alleged since Cuevas has not been convicted or even had a preliminary hearing, Ms. Dixon was in the hospital, went through recovery and has returned to work in dependency court.

There were five women today in court, most with masks so I have no idea who they are and what their connection is to Brewer-Hearst.

Usually, juvenile cases are held in a closed courtroom. Today, it was in open court. Brewer-Hearst is an adult now and what happens in his criminal case as an adult will impact his juvenile case.

There is another hearing scheduled in the juvenile case in two weeks on December 17. In the juvenile case, Brewer-Hearst cannot post bail.

No other media was in the courtroom. Today's hearing is a juvenile case which means the case, any details and court minutes are not visible in the public court system.

Today's representative from Probation is the best employee they have. I have seen her in court several times. Judge Neel is always compassionate but in juvenile court, I got to see the Judge Neel from County Counsel days when I worked at CWS. I also saw a gentler side of Ms. Dixon which is different than in criminal court. A balance of understanding where her client is coming from yet being firm and watching out for his best interests in court when he was "acting out."

12/4: Brewer-Hearst is scheduled to be arraigned this afternoon. The DA has charged him with 6 felonies. There are special allegations for two of those charges. 

Deputy District Ian Harris is the prosecutor for the adult criminal case. Arraignment was delayed this afternoon until Mr. Harris finished a preliminary hearing in another courtroom. When Brewer-Hearst came into the courtroom, he looked at me briefly, then sat down as instructed by the bailiff.

Public Defender's office was appointed; OR bail was waived without prejudice; bail in CR2403658 set at $145,000 by Judge Lawrence Killoran. Preliminary hearing scheduled for 12/12. in his juvenile case, there is a hearing on 12/17 on custody status. Brewer-Hearst cannot post bail in the juvenile case. On 12/23/24, he has a pay or appear hearing in the traffic case.

Some of the same women present yesterday were in court today. They were talking with a Victim Witness Advocate.
