After several days of testimony in a court trial on the sanity phase regarding Jasen Coley's additional plea of not guilty by insanity last month, Judge Gregory Kreis is expected to issue his ruling on 1/23/24 and victim impact statements are currently scheduled for the same day.
Coley already entered a plea to the charges and details are in previous coverage. His attorney, Mr. Michael Robinson, clarified on record that a shotgun was used and not a handgun.
Both the people's expert, Dr. William Darby and defense expert, Dr. Robert Soper testimony was favorable to Coley's NGI plea. You can read court minutes on the plea and the court trial in the previous post on December 8.
The chances that Coley is going to a State Hospital is looking more likely with recent filing. There was late discovery and a third doctor agrees with other two experts. Deputy District Attorney Candace Myers requested written briefs be filed instead of arguments.
Judge Kreis instructed attorneys to file paperwork by today. Mr. Robinson filed a post trial brief. Ms. Myers filed a closing summation brief. Responses are due January 10. The written ruling by Judge Kreis can be filed anytime before the January 23 date.
