John Chiv: Sullivan vs Rees, who will prevail in Jason Miller murder case?

Once again, Ms. Andrea Sullivan and Deputy District Attorney Roger Rees geared up to present their arguments regarding the defense motion in murder suspect Jason Miller's case.

Ms. Sullivan is asking to set aside charges and vacate the information. Mr Rees opposes the request to dismiss Count 1 and the special allegation.

The motion hearing had to be rescheduled to Court 5 because on 2/14, Ms. Sullivan filed a 170.6 disqualying Judge Lawrence Killoran. On 2/10, Mr. Rees filed a 170.6 disqualifying Judge Kelly Neel. Ms. Sullivan objected to the disqualification of Judge Neel.

The hearing had already been continued once and today the 995 motion was continued for the second time to 4/13. Offers were made by both parties.

If you read my preliminary hearing coverage, one of the issues I brought up was about the People's witnesses. Ms. Sullivan argued that point and tjat a body was never found. Hopefully, this case will resolve instead of wasting court resources on a muddy jury trial.

Trial assignment date of 2/17 and jury trial date of 2/21 vacated. Trial confirmation rescheduled for 5/11; jury trial for 5/30.
