Smash and grab suspect needs to prove he paid bail from legit funds and faces increase in bail

 


On January 26, I reported HCSO deputies  sat around all morning waiting to see if smash and grab suspect Nathan Ruptak's preliminary would proceed. 

There were discussions in chambers with Judge Kaleb Cockrum, Deputy District Luke Bernthal and Mr. Paul Gallegos. Then Mr. Gallegos spoke with his client. 

Resolutions talks are ongoing but time is running out for Ruptak who has 43 cases in the Humboldt Superior Court system. He has 4 open cases.

The preliminary hearing , OR/bail hearing and motion to amend complaint was continued to 2/9.  On the same day, a hearing on PC 1275 motion and motion to increase bail  requested by People will also be heard. A PC 1275 hold can be placed on a defendant's hold if a Judge determines the money to post bail came from criminal activity.  An inquiry at the hearing on 2/9 will be made to examine the sources of Ruptak's bail.

2/9: Preliminary hearing, motion to examine sources of bail, request to increase bail increase and motion to amend complaint continued to 2/27 because Ruptak has a virus and unable to come to court.
