Defense asks DA to recuse office due to donation in local GOP vandalism case

 


Trial confirmation is scheduled for GOP vandalism suspect Michael Valls on September 21. A motion to recuse the Humboldt County District Attorney's office from the case also is scheduled  on the same day.

Deputy Conflict Counsel April Van Dyke filed the recusal after she found public records that District Attorney Maggie Fleming had made a donation to the local Republicans. The DA's office has filed a response.

I reached to DA Fleming.

"I won’t be appearing on this case and our Office's written response will address the legal substance of the motion," said Ms. Fleming. "My financial contribution to the Humboldt County Republican Party was the purchase of three dinner tickets."

Jury trial is currently scheduled for September 27.




9/21:  Trial confirmation and motion to recuse DA was continued to October 14. Judge Timothy Canning found good cause and granted defense request to continue. There was no objection by Deputy District Attorney Ian Harris. Conflict Counsel Supervising Attorney Meagan O'Connell appeared on behalf of Ms. Van Dyke.

Jury trial scheduled for 9/27 was vacated.

10/14: Motion to recuse DA denied because the Judge felt it did not rise to the level of a conflict. Trial confirmation is on November 1; jury trial is on November 8.

11/1: Dates rescheduled. Trial confirmation 2/9/22; jury trial 2/22/21.

2/9: Jury trial confirmed for 2/22. Time estimate is 5 days.
