Kevin Haberman's preliminary hearing for his 2020 case started this afternoon after Deputy District Attorney Jane Mackie's motion to amend the complaint was granted by Visiting Judge Marjorie Carter.
In Count 1, the controlled substance was changed to heroin instead of valium. In Counts 4 and 5, heroin and fentanyl for sale are listed. After the preliminary hearing, the amount will be added with a special enhancement. In Counts 10 and 11, the date was amended from October 13, 2020 to February 4, 2020.
A certified rap sheet for Haberman with three different crimes,; two from March 2007 and one from November 1999 is People's exhibit 1.
Ms. Mackie said there was a change in witnesses. The first witness is Fortuna Police Officer David Ehler, currently assigned to the Humboldt County Drug Task Force.
In addition to his 2020 case, Haberman had three misdemeanor cases on for pre trial and one violation of probation case.
Haberman's attorney is Christina Allbright. HCDTF Agent Jack Bernstein, EPD Sgt. Stan Harkness and EPD Officer Nantz were mentioned during cross.
During cross, Ms. Allbright mentioned a"Ms. Pac/Pat". Hard to hear with audio issues and masks. She resides with Haberman. Ehler was unable to answer certain questions because either he did not write the search warrant or did not know.
No one saw Haberman drive the red Mercedes. He was seen exiting the car when one of the search warrants was served. Ehler had no idea who a car belonged to but it was in the original search warrant. He answered not sure to certain questions. Said it was in the original search warrant.
"I don't know which EPD officer. Sgt. Harkness told Officer Nantz and me they had observed heroin in the parked vehicle," said Ehler.
The heroin was seized prior to the search warrant so evidence would not be destroyed.
