Defense files 995 motion in Pamela Millsap case; motion to continue trial granted


Further trial confirmation was scheduled for murder suspect Pamela Millsap on this morning. Jury trial  scheduled for August 31 was vacated after defense motion to continue was granted by Judge Christopher Wilson.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Conflict Counsel April Van Dyke is Millsap's attorney.

Ms. Timm did not object to the motion to continue. As reported in the previous post, defense expert needs to examine the firearm.The People's expert at the DOJ "will be done in about a week" and this was the status as of last Friday.

Defense has also filed a 995 motion. That will be heard on September 8. Trial setting is scheduled for September 23.

Ms. Timm, once again, did not stipulate to chain of custody on a subpoena from a children's hospital. Ms. Van Dyke agreed to accept the document without a stipulation.

Millsap waived time. A referral to supervised release was made at the request of the defense.Ms. VanDyke will be filing a motion and asking for a hearing on tjat request.

Millsap is charged in Count 1 with PC 192 (a), voluntary manslaughter. Count 2 is PC 273 (a) (a), child abuse/endangerment with a special allegation PC 12022.7 (a) causing great bodily injury. Count 3 is PC 273 a (a), child abuse/endangerment with special allegation, PC 12022.5 (a), using a firearm in the commission of a crime.
