"This doesn't bode well for a Monday."

At trial confirmation this morning for murder suspect Pamela Millsap, further trial confirmation was scheduled for August 25 at the request of defense. Jury trial is scheduled for August 31.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Conflict Counsel April Van Dyke is Millsap's attorney.

Before the case could be called, Ms. Van Dyke wanted to briefly talk with Millsap. A simple phone call took few tries due to tech issues with phones at the jsil. "This doesn't bode well for a Monday," said Ms.Van Dyke.

Ms. Van Dyke said there were "a couple of outstanding issues. One is having the gun looked at; I can't confirm today."

Judge Christopher Wilson asked Ms. Van Dyke about documents in the file received by the Court in July that had been subpoenaed by the defense.

Ms. Van Dyke was surprised to hear about the documents. "None of the subpoenas have been given to me."

The documents were from St. Joseph's hospital and Redwood Regional Center.  Ms. Timm did not stipulate that the documents be provided to the defense.

Millsap is charged in Count 1 with PC 192 (a), voluntary manslaughter. Count 2 is PC 273 (a) (a), child abuse/endangerment with a special allegation PC 12022.7 (a) causing great bodily injury. Count 3 is PC 273 a (a), child abuse/endangerment with special allegation, PC 12022.5 (a), using a firearm in the commission of a crime.
