"Even if there is pornography, it is not an illegal commodity."



Convicted sex offender and molestor Michael Franco was sentenced in April  to 21 years in state prison. On August 25, there was a hearing on a motion to return property.

Franco is still taking up a local jail bed and has not been transported to prison.

Deputy Stacey Eads is the prosecutor for the case. Mr. Russ Clanton is Franco's attorney.

Ms. Eads conceded to the disposable camera. She said there was no contraband on it but she wanted to reconfirm with the investigator.

Ms. Eads objected to the laptops saying there was pornography on them.

Mr. Clanton said, "Even if there is pornography, it is not an illegal commodity."

Mr. Clanton said "there were things taken" from Franco's Dodge Durango and "indicia from Mr. Franco's house in Templeton."

Of the six items requested, Mr. Clanton asked for a written response from Ms. Eads regarding each item.
Judge Christopher Wilson agreed and asked for specifics.

Ms. Eads said there was child pornography on the laptops; specifically involving Jane Doe. Ms. Eads she said that wouldnot be released.She said there were certain items that Franco's girlfriend "may not acquiesce."

As she was speaking about Jane Doe, Franco interrupted "That's a lie. That statement is not true."

"Mr. Franco, you sit tight," said Mr. Clanton.

Ms. Eads was given 30 days to file her written response. Then Mr. Clanton will file his reply. Ruling on the motion is scheduled for October 7.

Another unrepentant, child molestor and sex offender showing no remorse after his plea. Convicted twice of the same offense and still defiant.
