Three cases for Brian Daniels, one every year since 2018
Brian Daniels had a 2018 and 2019 case on calendar on May 7. Trial confirmation was scheduled for the 2019 case. The trial date for the 2019 case was vacated.
There are charges for a 2020 case but no arraignment date had been scheduled yet. Judge Timothy Canming did not have that case on calendar so he was unaware there was a third case until Deputy Conflict Counsel R. J. Leohner told him.
Mr. Leohner requested a trial setting with all three cases, hoping for a global resolution. That date is June 18.
Charges for the 2020 case are VC23152 (a), DUI and VC23152 (b), driving with a blood alcohol concentration ("BAC") of 0.08% or higher. No arraignment date scheduled yet.
Charges for the 2019 case are Count 1 and Count 2 both felonies, PC 422, threat to commit crime resulting in great bodily injury or death. Count 3 is a misdemeanor, PC 417.4, draw or exihibit an imitation firearm.
