Chad Smith gets sentenced to 11 years, in prison, two to be served concurrently



Chad Smith was sentenced today to the stipulated term of 8 years in prison for pleading guilty to one count of molesting his step daughter and for the violation of  three restraining orders that the jury found him guilty of after his second jury trial. He was sentenced to one year consecutive on one of those counts and one year each on the other two counts to be served consecutively. Total prison time is 11 years.

As part of his plea, Smith waived all his pre sentencing custody credits and right to appeal.
His attorney, Ms. Andrea Sullivan said the pre sentencing credits total "almost three years." He has to register as a sex offender. Smith can be placed on parole for up to 10 years. Restitution is reserved but Smith was ordered to pay specific amounts to both Jane Does.

Smith was served with a protective order in court preventing him from contact with Jane Doe 1, her mother (they are in the middle of a divorce) and his son. Another order is expected to be filed for Jane Doe 2 and her family.

An unrepetentant, arrogant Smith glared at Jane Doe 1 and 2 and their families and stared at them during victim impact statements.

"What words do you use when you describe your own rape?" said Jane Doe 1, his stepdaughter. "I don't hate Chad Smith. I pity him. I wanted him to plead guilty to everything but the fact that he said guilty is good enough."

Judge Lawrence Killoran spoke after each victim impact statement commenting on the angst suffered and he commended both Jane Doe 1 and 2 on their bravery.

While speaking to Jane Doe 1, he teared up.
"I am very sorry these things happened to you. I read your letter yesterday. It affected me deeply."

Deputy District Attorney Stacey Eads said that Smith "represented to the probation officer that he did not do anything wrong but as a favor so everyone can move on with their lives."

Ms. Eads described Smith as a narcissist. She said he had a grandiose sense of importance and entitlement.

No other media was in court. Five members of the local chapter of Bikers Against Child Abuse were at the hearing.
