Seng Yang, the man charged with raping his own daughter ignores the Judge and his attorney again,has to be escorted out of court by two bailiffs



Trial confirmation was scheduled this morning for Seng Yang.

Yang is charged with 16 counts which include forcible rape of Jane Doe (his own daughter) and exhibiting a minor in pornography.  Jane Doe is the alleged victim for all counts.

Text messages and pornographic videos are part of the evidence.



Despite having his second Marsden motion denied. Despite being called out in court by one Judge for speaking English at a previous hearing  ( a court certified Hmong interpreter has to be brought in from Sacramento for each hearing), Yang continued to make matters worse for himself today in court.

Public Defender Marek Reavis told Judge Lawrence Killoran, " We confirm for trial. I received an email from Ms. Kelly Nyberg that Ms. Eads has a jury trial in place on the 21st. We are pulling our time waiver today."

Yang's jury trial was scheduled for February 25, the same day  the Cory Fisher jury trial was scheduled to start. On February 21st, motions in limine and review of hardship questionnaires are scheduled in the Fisher case.

Deputy District Attorney Stacey Eads said jury interviews in the Fisher case are expected to start on February 27. She expects to file a motion to continue in the Yang case as she is the "specially assigned prosecutor". Ms. Eads said she will not file the motion, "unless necessary" hinting at a possible resolution or change in the Fisher case.

Yang burst out and said, "I want to take six years now." Mr. Reavis told him, "They are not offering you six years."

Judge Killoran instructed Yang to address the court via his attorney.

"I have conveyed that offer to the People and they rejected at it," said Mr. Reavis. Yang's offer was 6 years and pleading guilty to two counts.

Ms. Eads confirmed that the People had rejected Yang's offer and told Judge Killoran if Yang was going to speak himself and not through an interpreter or his attorney that his remarks be a part of the record.

"I have instructed Mr. Yang not to speak. Mr. Yang seems unwilling to use assistance of his counsel " said Mr. Reavis.

Dates scheduled "remain set" for now. Two bailiffs had to come into the courtroom to escort Yang who remained defiant and in denial.

Today, Ms. LeBeka Xiong interpreted for Yang.
His family was not in court today.
