Defense files motion to continue Island Mountain armed robbery suspect's preliminary hearing
Intervention was scheduled this afternoon for Island Mountain armed robbery suspect Franklin Molina. Defense filed a motion to continue the preliminary hearing. Ruling on that motion was scheduled for the 10:15 calendar.
Judge Christopher Wilson granted the defense motion since there was no objection by the People.
The preliminary hearing scheduled for February 26 was vacated. This decision was made because the People had filed a motion to amend the complaint today. That motion was not in the court file and defense did not have a copy.
Instead on February 26, there will be a hearing on the People's motion to amend the complaint and trial setting is also scheduled for the same day.
Deputy District Attorney Trent Timm appeared in court today for the People. Deputy Public Defender Casey Russo is representing Molina.
