Jane Doe's mother wipes tears in court as former Miss Hoopa sentenced to 120 days in jail, 150 hours of community service and 5 years probation

Sentencing was scheduled for former Miss Hoopa, Kayla Brown on February 11. Brown entered a conditional plea on January 11. She was sentenced today.

Brown was sentenced to 120 days in jail with credit for time served, 150 hours of community service and 5 years of formal probation. Brown has to commit to jail on March 16.

A restitution of $310.98 was ordered to be paid to Jane Doe's mother.

Brown pleaded guilty to Count 2, sexual penetration of a minor under 16 years old and Count 3 contact with a minor for sexual offense. A protective order stating no contact with Jane Doe and her family was requested by the People. It is a part of the terms of Brown's probation but she was also served with the order in court today.

Brown has to register as a sex offender,"for at least 10 years" according to Mr. McLaughlin.

Judge John Feeney did deviate a bit from the probation recommendation. He acknowledged that while this case has been protacted and painful for both families, prison time was not warranted. Judge Feeney pointed out that Brown had no prior criminal record.

While she could apply for SWAP, sex related crimes are ineligible for SWAP.

Deputy District Attorney Carolyn Schaffer prosecuted the case. Brown was represented by Deputy Public Defender Ben McLaughlin.

There was one correction made in court today with Count 3 being amended from PC 288 (c) 1 to PC 288.3 (a) with the purpose of committing PC 289 (i).

I have followed this case for 4 years consistently. On January 4, 2016, a conditional plea was rejected by Judge John Feeney.
