I had reported on April 19 that there was a civil appeal filed in Munson et al. v. City of Eureka et al. Today, that appeal was dismissed.
Case: A170018, 1st District, Division 2
Disposition date (YYYY-MM-DD): 2024-05-07
Disposition description: Dismissed per rule 8.140(b)
Disposition status as of 2024-05-07: Final
Notes:
The appeal filed on March 18, 2024, is dismissed because appellant failed to procure the record on appeal within the time allowed or within any extensions of time, after issuance of the default notice on April 3, 2024. Appellant also failed to apply for relief from default. (See Cal. Rules of Court, rule 8.140(b)(1).)
City of Eureka Assistant Manager and Clerk Pam Powell and City of Eureka Attorney Autumn Luna told me, "This is a good outcome for the city. Thank you for reaching out."
The post has been updated to include the motion for relief from default & to reinstate appeal which was granted on 5/31/24.
