Setting of a new trial dates, setting of pre trial motions and 502 hearing for Ray Christie is scheduled tomorrow. Judge Christopher Wilson was very clear that just dates would be set on October 6 so I will add an update to the post tomorrow.

The hearings to cover are the motions in limine and the 502 hearing. On October 1, Mr. Rick Richmond filed a declaration and defendant's brief regarding substance, scope and scheduling of evidentiary hearing.

Will the court have copies of these documents or like last hearing have to skim through the copy provided by defense?

There will be a future and separate post addressing the current short staffing and exits of experiened staff affecting the local court system. The chaos isn't necessary. If you read my blog regularly, you shouldn't be surprised why and who is making dumb and incompetent decisions, including about staffing that impact people's lives, freedom and livelihoods constantly screwed up by Humboldt backwoods justice.

I am printing excerpts of the new defense documents. I am not including every page, table of contents,  table of authorities so the pages in the brief will not be in chronological order. These are just highlights. Both documents are exceptionally well written with exhibits. Unlike Christie's prior counsel, easy to understand, relevantcontent and actual legal documents.

After the last hearing on September 20, several transcripts were requested by the Larson Law Firm. These are referred to in Mr. Richmond's declaration.

Mr. Richmond is one of four attorneys from the Larson Law Firm working on Christie's case. Mr. Richmond and Ms. Caroline Glennie-Smith, one of the Larson Law firm associates will be at the October 6 hearing. Another associate Mr. Nate Wright will be present via Zoom.

Deputy District Attorney Steven Steward is prosecuting the case. No response by the DA had been filed or entered in the e court system when I checked this afternoon.

"They seek to depict Mr. Christie as a liar by introducing evidence of an alleged tag switching scheme and to paint him in a bad light with photographs of dead cows.  These other alleged bad acts are not relevant to the charged felony counts of animal cruelty.  In addition, the People have offered insufficient proof that Mr. Christie had charge or custody of the cows in Count 4.  Instead, the People have relied on confusion they themselves generated regarding which evidence related to which properties.  As a result, evidence regarding Count 4 should be excluded from this trial."








10/6 after hearing update: A hearing is scheduled for November 15 for attorneys to present arguments on motions in limine. There maybe more hearings set on evidentiary issues after that date. Counsel are to meet and confer before 11/15/21 to determine which issues will be presented before the court.

Trial confirmation is on January 18; jury trial on January 31.
