Meserve's attorney wants depositions of former HCSO deputy Hass, HCSO Sgt. Freese and former Deputy Luke Brownfield


Another case management conference was scheduled for on May 12 for convicted rapist Kailan Meserve's writ of habeas corpus.

Meserve's attorney said that after reviewing the transcript of HCSO Sgt. Diana Freese, he is filing a motion to take depositions of Sgt. Freese, former Deputy District Attorney Luke Brownfield and former HCSO Deputy Mike Haas.

Deputy District Attorney Carolyn Schaffer appeared for the People. The District Attorney's Office is filing a motion to compel.

Another case management conference and "tentative date" to hear motions is scheduled for July 22. Given the impact of the coronavirus on the courts, Judge Christopher Wilson said if an evidentiary hearing needs to be set, he cannot guarantee that but he will try and hear the motions and make a ruling on the July date.

I have also reported o Meserve's appeal. The First District Court had granted a stay of Meserve's appeal but it was lifted because the appellant failed to timely apprise the Appellate Court regarding the status of the habeas proceeding.
