Antone Aubrey's preliminary hearing could take half an hour or three hours


Setting of Antone Aubrey's preliminary hearing was scheduled this morning.



The case is being prosecuted by Deputy District Attorney Candace Myers. Ms
 Sarah Zalkin appeared in court today for Aubrey's attorney, Mr. Russ Clanton.

Aubrey withdrew his time waiver today. The preliminary hearing is scheduled for March 5.

Ms. Myers told Judge Timothy Canning that, "both Mr. Clanton and I are anxious to resolve this case" and that she had no objection to Aubrey's request to withdraw his time waiver.

Ms. Myers said the "time estimate is subject to civilian witnesses" and their availability and schedule. "So it could be fairly quick; a half an hour with just the detective ideally with live witnesses, substantialy longer" The time estimate put on record was three hours.
