If the Arcata City Council rejects Kyle Zoellner's claim, and if he decides to file a lawsuit, hopefully he will hire a lawyer, one who has experience with such lawsuits.

Whether someone helped him with this claim or he wrote it himself, just throwing in bunch of legal lingo doesn't mean you have a case.
You have to prove these claims in court. Can Zoellner be successful, who knows? Without hearing arguments and what evidence both sides will present, it is all speculation.

In the preliminary hearing, Officer Devin Nielsen said  that Zoellner denied medical attention.

So, it is the officer's word vs. Zoellner. If the officer's body camera has a recording and it supports Officer Nielsen's statement, then that part of Zoellner's claim is easily disproved.

Another question Zoellner better be prepared to answer is why file the claim now? Nothing in his narrative suggests any new information so why wait almost 7 months to file a claim?

  1. So it's not S.O.P. to have a suspect who had obvious head injury's cleared by medical before booking??? The county and C.O.A. are about to loose several million dollars. Can you guess what case has precedent??

    1. The one person I have no sympathy for in this situation is Officer Devin Nielsen. He did not handle the situation well at all. The hostile screaming crowd did not help the situation but
      he arrested Kyle Zoellner because people at the scene told him so. APD Officer Krystale Arminio even testified during the preliminary hearing that she asked Officer Nielsen why Zoellner was already cuffed and in the car. Whether Zoellner's claims can be proved in court remains to be seen.

  2. this looks oddly familiar didnt someone just make alot of money off a fake claim that EPD beat him up??? maybe a certain marxist group?
