Would Kyle Zoellner's court history have made a difference during the preliminary for the murder of David Josiah Lawson?

The most recent case for Kyle Zoellner was from 2017 in which he was charged with the murder of David Josiah Lawson. That case was dismissed due to lack of evidence, after the preliminary. The investigation is not over. There is a 2013 case which resulted in no charges being filed againt Zoellner but the alleged crime listed was a felony PC 245 (a) (1), assault with a deadly weapon.

The rest of the cases include charges ranging from possession of marijuana, posession of meth to exceeding the speed limit.

Is Zoellner prepared for more scrutiny if he pursues a lawsuit against the City of Arcata?

Had this information been available during the preliminary of his criminal case for the murder of David Lawson, would it have made a difference?

  1. I thought the family responded to questions about his history in their press release type things. I'm pretty sure this was out there

    1. His family may or may not have sent out their opinion of his history. They sent out a lot of stuff, selectively to press, whatever and whoever suited their whims at the moment. I don't care what his family and friends or some random strangers think. These are court records. They are facts and legal records, not opinions, feelings and subjective interpretations.

  2. What's the criminal record of the deceased? We all saw his facebook page. We all saw his lust for violence and his racist crap. And what of his homie who probably iced him? What's his background? I won't mention their names. They aren't worth mentioning.

    1. Do you have evidence of their criminal record? If so, provide it. If not, I don't print hearsay. I took a lot of crap for my factual reporting of the preliminary from one side. Now it is the other side throwing a fit. News is facts. I have tons of news to cover,many other court cases, all this takes time. Public court computers are in demand. Unless you want to pay me for my time, I dont have the luxury to chase down records that may not even exist in a case that is emotionally fueled by morons on both sides. A young man is dead, no witnesses came forward and if I research, I am pretty sure I will find records on a few people. I already have. Takes a lot of time to do complex court reporting. I dont throw together press releases or slap together half ass information.

  4. And for all the hubbub and press releases coming out of HSU and Arcata: It is less than a year. Home many unsolved murders have there been in Humboldt since Jan 1, 2017. I know people are still hurting and want to express anger but if these are intelligent, educated people they should recognize that.     prepared August 17, 2017 It's a pdf. And this is for your readers John, not you. You've got enough to do.

    According to the report (the graph is sideways so difficult to read) there were 16 homicides in Humboldt County in 2016.

    This information is also in the study. It is well worth noting. Make of it what you will:

    "In 2016:
    89.0 percent of homicide arrestees were male and 11.0 percent were female. (Table 30)
    42.8 percent of homicide arrestees were Hispanic, 27.8 percent were black, 20.7 percent
    were white, and 8.6 percent were of other race/ ethnic groups. (Table 31)

    51.7 percent of homicide arrestees were aged 18-29,
    22.6 percent were aged 30-39,
    19.4 percent were aged 40 or older, and
    6.3 percent were under the age of 18. (Table 32)"

    1. Fact: facebook page posts or photos mean nothing unless they are used in a court and evidence is provided and the person is convicted. Instead of trying to make your opinion fact, and thinking the more you insist and the more comments you send, everyone will cave into your opinion, learn the difference between oinion and fact. Start by reading my comment on 9:40 p.m. I am getting tired of explaining the same thing. You are anonymous, you keep harping on the same thing, so your furure comments will not be printed if they harp on the same thing.

    1. Rusty, as already explained above, anon does not have any facts. If anon had any evidence, anon would have provided it. In this case, both sides are guilty of a lot of emotion. Just because you or anon or anyone else types the same opinion over and over again, it is not fact. We may agree a lot but if duplicate comments and shit stirring starts from either side in this case again, comments are and will be moderated.

  9. I am a friend of Lawson family. I can tell you that you will find no arrest record for Josiah.
    If we all could remember that a kid was stabbed to death and a mother is grieving, and to realize that someone is out here who did this, then maybe and hopefully justice will be brought sooner than later.
