Mr. Griego's motion of issuance of requested writ:
P.1:
"The Board of Supervisors has a mandatory duty to comply with Government Code (“GC”) §27701, which states: "A person is not eligible to the office of public defender unless he has been a practicing attorney in all of the courts of the State for at least the year preceding the date of his election or appointment." The Board of Supervisors violated GC §27701 when they appointed David Marcus (“Marcus”) as the Humboldt County Public Defender. At the time of the appointment, Marcus was working as a Florida insurance adjustor after being the subject of a scathing Grand Jury report during his last stint as a lawyer. Marcus had not been a practicing attorney in the courts of California for more than five years. The Board’s appointment of Marcus has caused actual harm to the Public Defender Office, its clients, and the Public. Petitioners include named representative citizens and taxpayers of Humboldt County, current and potential future clients of the Public Defender’s office and attorneys and staff members of the Public Defender’s Office. The court has ruled each has standing to pursue this writ. Petitioners respectfully ask this Court to issue a writ of mandate; preliminary and permanent injunctive relief; and declaratory relief. Specifically, Petitioners seek an order directing the Board to set aside the February 7, 2017 appointment of Marcus and an order declaring that Humboldt County Code 2410-1 does not comply with the requirements set forth in GC §27701."
