Judge Reinholtsen grants continuance in James Merrick case stating that forcing a trial when defense counsel needs time to prepare is not legally prudent



Judge Dale Reinholtsen said that forcing a trial when defense counsel needs more time to prepare is not legally prudent and that despite the objection by the People, he was granting the defense to continue in James Merrick's case.


Merrick had further trial confirmation scheduled today. as well a defense motion to continue the jury trial. Based on the same reasons that were stated at the last hearing, the motion to continue was granted.

Defense is waiting for an report from their accident reconstruction expert. Deputy Public Defender Meagan O'Connell took over Merrick's case and today was the first day, she appeared on his case.

She will be meeting with the investigator on this case in two weeks and should have an update on status of the report. Ms. O'Connell requested a setting date in two weeks.

Deputy District Attorney Brent Kling did object to the motion to continue, stating many members of the victim's family were in court and they were also entitled to a speedy trial.

He spoke with family members after the Judge's ruling.

Setting in November 9. Jury trial for November 20 vacated.
