Hoopa teen charged with death of 52 year old enters additional plea of not guilty by insanity
Setting for Richard Dean was scheduled this morning. He is the Hoopa teen charged with the stabbing of the 52 year old in Arcata in January 2016. He entered an additional plea today of not guilty by insanity.
Intervention is set for November 6. Preliminary for November 8. Deputy District Attorney Stacey Eads and Deputy Public Defender Kelly Neel have discussed and submit doctor recommendations by intervention.
Criminal proceedings had been suspended for Dean. In May 2016, Dean was admitted to Napa State Hospital. In March 2017, after a six month review, Dean was awarded a certificate of mental competency.
His preliminary was set for September 27. Intervention for September 25. Both were vacated. Setting for dates is on October 19.
Deputy District Attorney Stacey Eads is prosecuting the case. Deputy Public Defender Kelly Neel is representing Dean.

What the heck people. Napa loonie tune hospital declares him sane-so why the willingness of the courts to let this weasel say I'm nuts and insane????? Kelly Neal-you need to back off and let the dtermination by Napa stand true and be accepted.
ReplyDeleteIt isn't quite that simple. Competency to stand trial is not the same standard as NGI. NGI relates to his condition at the time the offense was committed, so the fact that's he been restored to competency isn't dispositive. He was at Napa for 6 months before he was restored to competency, so it's certainly possible that he was in a significantly worse state when he went in.
DeleteSeems the flavor of the week, the "mental health" defense. No, actually, I'm sure it's just a coincidence that what, 4, 5, 6 of these claims- incompetence, insanity, or both- have popped up recently. No way a lawyer would stall, obfuscate, or mislead the court.
