Trial confirmation was scheduled for Bryan Ross Main today; instead he plead out. The negotiated plea is for three years in custody. This is not final until sentencing.
Main had signed a plea form, which he had gone over with Conflict Counsel Supervising Attorney, Kaleb Cockrum. Deputy Conflict Counsel Meagan O'Connell spoke at length with Main before the plea was accepted by Retired Judge Bruce Watson and during the plea, with both explaining and answering questions Main had. He would answer, "I understand."
The special allegation to Count 1 and Count 3 were dismissed.
Main was charged with three counts. He plead to failure to register as a sex offender and unlawfully touching a minor. Judge Watson told Main that he will have to register as a sex offender for lifetime, no matter where he lives.
Count 1 sentence can be two to three years in custody. Count 2 one year sentence in custody . Part of the plea agreement is that for Count 2, no additional jail time would be sought.
Deputy District Attorney Carolyn Schaffer told Judge Watson that the dismissals were based on the "age of the defendant and the relative lack of criminal history."
A referral was made to Probation for custody credits. Sentencing is on Nov 6 at 8:30 a.m.
Time was waived for sentencing. The defense wanted two months so Main could "take care of his affairs". The People requested a speedy sentencing.
A couple, friends of Main, have been present at every hearing. Usually, they do not express any feelings in court. Today, the wife was very emotional and disruptive throughout the court proceedings. She was talking loudly, commenting on the case and yelling, "he does not understand". Towards the end she stood up in court.

The woman who said "He does not understand"...was she referring to Bryan Ross Main (since he had replied to the charges saying he understood) or someone else?
ReplyDeleteWhy bring something like that up now? If it's a case of diminished capacity, surely that would have arisen before this. If they've been in court and followed what was happening, what did they
expect would happen?
She is a friend of Main and was referring to him. There has been no finding of diminished capacity. As the case has proceeded, she has become more emotional.
