There have been three important developments in a local lawsuit. One I already reported on five days ago.
On August 7, I reported that local attorney Randall Davis is no longer representing Dwivedi Tower LLC and Mr. Anil Dwivedi in the lawsuit filed by local firm Janssen Malloy on behalf of Don Swall and Vanessa Vachon who are two current tenants of the Hillsdale Apartments in Eureka. Janssen Malloy Senior partner Mr. Patrik Griego recently took over the case from Ms. Meagan Yarnall and Mr. Jeffrey Slack.
Dwivedi Tower LLC and Mr. Dwivedi are represented by San Francisco Dhillon Law Group's Mr. Anthony Fusaro who is now co-counsel with Ms. Krista Baughman.
I check this case every day. The August 4 filing by Dhillon Law Group was not entered into e court until today, despite the entry date in e court stating August 4. In defendant's answer to the second amended complaint and affirmative defense, the ninth affirmative defense claims Dwivedi Tower LLC are "exempted from liability under Civil Code 1947.12" and "Civil Code 1947.12 (d) (4).
The defendants are also asking Judge Timothy Canning to strike/dismiss the entire second amended complaint. There is a case management scheduled on 10/10/25.
I briefly contacted Mr. Griego and Mr. Dwivedi to let them know I was doing this post and would email them for any written response, if they wish to comment.
I have previously disclosed that I moved into Hillsdale Apartments after covering this lawsuit and I plan on moving. Janssen Malloy only recently advertised with me this month. Those who have followed my blog for 11 years and those who know me longer do not need this disclaimer. My advertisers are there in fixed spots for anyone to see.
