Convicted criminal and repeat offender Nicholas Sarkozy had a good offer from the People pre preliminary hearing; now he can deal with the consequences of the choice he made

 

On Friday 7/11, after the preliminary hearing in convicted criminal and repeat offender Nicholas Sarkozy's 2025 case for his most recent arrest, Retired Humboldt Superior Court Judge Christopher Wilson held Sarkozy to answer to all three felonies : Count 1 PC 273.5 (a) domestic violence, 2 PC 236 false imprisonment and  Count 3 PC 136. 1 (a)(2) attempting to dissaude a witness. 

Judge Wilson ruled there was not sufficient evidence to Count 4 misdemeanor PC 273. 6 (a) violation of a domestic violence court order.  Judge Wilson made "no finding one way or the other to to requested additional count of PC 422 criminal threats" requested by Deputy District Attorney Brandon Boozari.

During cross examination of HCSO deputy Olivia Alves, Deputy Conflict Counsel Zach Curtis asked about Jane Doe's height. Deputy Alves estimated it to be 5 '4 or 5 '3. HCSO Deputy Hal Esget was the other witness for the People.

Arraignment on information is on 7/24.

7/24/25: Readiness conference on 9/4; 9/15 jury trial.

9/4/25: Jury trial remains set. Time estimate 5 days.

9/15/25: Jury trial continued to 9/16; no judge; no courtroom.

9/16/25: Continued by court, no judge, no courtroom to 9/22. 

9/22/25: Jury trial continued by defense to 10/6 due to new discovery over Sarkozy's objection. Court minutes indicate the October 6 date is a must go. A Marsden hearing is scheduled for 9/25. Readiness Conference on  9/30.

9/23/25: Arraigned in CR2502092. Conflict Counsel appointed.

9/25/25: Marsden motion denied by Humboldt Superior Court Judge Lawrence Killoran.

9/30/25:  In CR2501309, Readiness conference continued by defense to 10/3;  trailing CR2502092. Jury trial scheduled for 10/6. Preliminary hearing scheduled in CR2502092 for 10/3.
