Defense wants to exclude Dare's prior conviction for misdemeanor domestic violence and substance abuse

On October 23, Deputy District Attorney Carolyn Schaffer  filed a motion to amend the complaint for alleged molestor Mark Dare to add a special allegation of the "one strike law." See yesterday's post linked below for more details. That motion was granted today by Judge Gregory Elvine-Kreis. He said the age of the victims was known facts and this was an issue for sentencing.



After court yesterday, Public Defender Marek Reavis filed a motion in limine to exclude Dare's prior conviction for misdemeanor domestic violence and substance abuse.

Due to court availability, Dare's case is on for trial assisgnment on November 1. Mr. Reavis brought up this may be an issue as defense expert witnesses are scheduled for November 14 and 15 and they have limited availability. DA Maggie Fleming said the People will object to witnesses being called out of order. Judge Elvine-Kreis said the trial judge can address that issue.

Dare was in court with his parents. This is the second hearing his wife and church supporters have not been present. Time estimate is four weeks.
