"The issue whether Mr. Rodriguez's rights were violated has been reserved for appeal"



Trial confirmation for murder suspect Ulisses Rodriguez was scheduled for June 19. Defense motion to continue was  granted. Setting is on July 22.



Even though Rodriguez declined to enter a time waiver petsonally, his attorney, Deputy Public Defender Ben McLaughlin said the law allows him to enter a time waiver over his client's objection so he has adequate time to prepare for trial.

"The issue whether Mr. Rodriguez's rights were violated has been reserved for appeal," Mr. McLaughlin told Judge Lawrence Killoran.

Defense is waiting on certain reports which will determine timing. The earliest defense will be prepared is next January or mid February.

Deputy District Attorney Luke Bernthal said while the People are ready to proceed, the defense's statutory right to be prepared trumps a speedy trial.

Jury trial for June 24 vacated. Rodriguez has shaved his beard and looks very different from his booking photo.
