Sexually violent predator Joshua Cooley denied transient release, most likely he is Tehama bound


Sexually violent predator Joshua Cooley was denied transient release in Humboldt County as requested by defense. No permanent placement could be found in Humbolt. Liberty HealthCare looked at properties all over California. A property and permanent placement was identified in Tehama County, Red Bluff area.


"There are certainly no easy decisions (in this case)" said Judge John Feeney. "I'm very mindful of the fact that Mr. Cooley has significant family ties in Humboldt. I'm also mindful as set forth in the December 6 letter by Mr
 Loya thattransient release requires increased staffing" and increased administrative resources.  The report by Liberty HealthCare also reiterated that transient release would result in less chance of Cooley being successful in the outpatient program.

Judge  Feeney ordered a referral to CONREP in Tehama County and Liberty Healthcare to work on that out of county placement.

Mr. Loya of Liberty Healthcare told Judge Feeney that "the Court has to notify Tehama County."

Deputy District Attorney Stacey Eads  provided Welfare and Institution Codes 6608.5 and 6609.1 to the Court regarding out of county placement noticing.

Most of Ms. Eads and Ms. O'Connell's comments today have been covered in detail, more than once, in previous coverage.

There are three more dates scheduled. They have to do with noticing requirements and review. They are December 17, January 28 and February 20. The last two dates might change Monday.

I have put in a lot of time into this case and now that transient release in Humboldt has been denied and now the case has been referred to Tehama County, this maybe be the last update.
