Today Ewa Misztal entered a "dual plea"; this morning it was "not guilty by reason of insanity"



A trial setting was scheduled this morning for Ewa Misztal in Courtroom 2. Instead, Misztal entered a dual plea.

Today, Misztal entered her "additional plea" of not  guilty by insanity. Two doctors were appointed, Dr. Soper and Dr. Chamberlain; prosecution has a right to request third doctor, if neccessary.


Status of doctor's report scheduled for August 24 at 8:30 p.m. in Courtroom 2.


The first continuance was requested by defense to see if Misztal wanted to enter a dual plea.

At the last hearing, Visiting Judge Robert Crone said attorneys needed more time to make recommendations to the Court.


After the last court hearing on July 19, I asked DDA Schaffer if the time was to make a list of  doctors to recommend to the Court, and she said, yes.

Deputy District Attorney Carolyn Schaffer is prosecuting this case. Deputy Public Defender Casey Russo is representing Misztal.

Trial setting has been continued twice; from July 5 to July 19 to today, July 27.

Misztal has already entered a plea of not guilty. She has to decide whether she wants to also enter a plea of not guilty by insanity.

If she does, the process will be similar to the Gary Lee Bullock case and trial, including court appointment of two doctors to evaluate Misztal.

Misztal is charged with the death of her baby.
