I am still getting details but the winter storm took a bite out of the 5th floor of the Courthouse, there was no power. A leak on the 5th floor has water coming down into the District Attorney's office.
The Clerk-Recorder's office is on the 5th floor. I will update the post with any new information.
On 12/5/22,there was a hearing on the defense PC 1203.4 petition dismissal & expungementin Joshua Grow's 2016 case. The court referred it to probation and it was on for ruling yesterday. The motion was denied by Judge Kaleb Cockrum. He said Grow is ineligible for PC 1203.4.
Defense 17 (b) motion was granted without prejudice. A 17 (b) motion reduces a felony to a misdemeanor. Judge Cockrum wanted to hear from victim and get information regarding Grow's steps towards rehabilitation. E-court states case is closed and no future date is listed.
On January 1, I reported that 25 year old Brian Lee Garrett was arrested by Eureka Police Department for PC 597(a) animal abuse/cruelty and PC 597(b) cockfighting.
Jury selection and individual interviews are going on in Courtroom 5 for alleged molestor Miles Neiva.
Neiva is charged with Count 1, PC 288.7 (b) oral copulation or sexual intercourse with a child 10 years or younger and Count 2 PC 288 (a) lewd and lascivious act with a minor under 14.
Jerri Rebekah Cardelli was arrested yesterday at midnight by Fortuna Police Department on a bench warrant for bench warrant in a 2022 case for PC 484 (g) fraudelent use of a credit card, PC 496 d (a) buying or receiving a stolen vehicle, VC 23103 (a), VC 10851(a). She was released on O.R.
Humboldt County Public Works just issued the following alert.
"Tree and power lines down on Kneeland Road at Greenwood Heights. PG&E has been notified and the issue will be cleared as soon as possible; drive with caution and use other routes."
A minute later another alert. "Road Closed at Central Avenue and Bella Vista Road due to a downed tree blocking all of Central Avenue."
PG&E is mobilizing personnel ahead of a significant wet and windy winter storm due to arrive across Northern and Central California Wednesday and into Thursday.
On September 7, alleged molestor August William J Real III had his preliminary hearing and was held to answer to Count 1 and 4. Real was not held to answer to Count 2 and 3 by Judge Kaleb Cockrum.
On December 30, at intervention, Judge Kelly Neel accepted Real's conditional plea to Count 4. The trial confirmation date scheduled for today and jury trial for next Monday was vacated.
While the rest of us abided by the rules and did not take photos because they are not allowed in the courtrooms and on the second floor, why should that stop Rex?
Judge Christopher Wilson retired last month and had his retirement and goodbye parties. Today was Judge Steward's enrobing ceremony. Judge Wilson administered the judicial oath.
Judge Steward was elected to fill Judge Wilson's seat. Just like Rex to muddy up the waters with a photo caption. Rex is clueless about the courts and should stay away.

I have known for a while that Humboldt County Superior Court CEO Kim Bartleson has been working from home except for the occasional meeting. The reason is a personal one that she shared with me and not necessary to broadcast on this blog. She has not been at the courthouse for months and was not at Judge Steven Steward's enrobing ceremony.

Judge Steven Steward had his enrobing ceremony this morning in Courtroom 1 this morning. Overflow seating was available in the jury assembly room where the ceremony was televised live.
Alderpoint homicide suspect Jake Combs trial confirmation this morning was continued and defense motion was granted. Attorneys stipulated to release of subpoenaed records to DA for copying. Those records were from Humboldt County Correctional Facility and St. Joseph's Hospital.
Brandon James Phelps was arrested yesterday by HCSO for PC 207 (a), kidnapping PC 261 (a) (1) rape of a person incapable of giving consent because of a mental disorder, developmental or physical disability and this is known to the perpetrator and PC 273.5 (a) corporal injury to spouse/cohabitant.
I did a post on Phelps's arrest in 2018. He already had 16 cases in the court system before that arrest.

A warrant had been issued at the last court date for Gary Cudney since he has missed the last two court dates. Cudney was charged with Dirty Dave's death.
