On 2/1, preliminary hearing was scheduled for Carlos Portillo and Luis Portillo. Both resolved their cases with pleas. Carlos Portillo entered a conditional plea for a stipulated term of 7 years. Luis Portillo entered a conditional plea for a stiuplated term of 12 years. Sentencing is on 2/28.
Details of pleas with what each defendant pleaded guilty to and which counts are dismissed are in the court minutes. Both pleaded guilty to Count 2 PC 264.1 (a) forcible rape while acting in concert as a serious violent felony. That penal code is commonly referred to as gang rape.
You can read what they were charged with in first amended complaint which was entered in e court on 12/5. Deputy District Attorney Whitney Timm is the prosecutor for both cases. Carlos Portillo is represented by Conflict Counsel Supervising Attorney Meagan O'Connell. Luis Portillo's attorney is Ms. Andrea Sullivan.
